Bald Eagle Delisting Comments (PDF)

BRA in association with Holland & Knight (H & K) submitted comments to the U.S. Fish and Wildlife Service (USFWS) regarding the proposed: 1) delisting of the bald eagle from the ESA, 2) definition of “disturb” under the Bald and Golden Eagle Protection Act (BGEPA), and 3) National Bald Eagle Management Guidelines that will implement the disturbance rule. As you will note, the legal analysis prepared by H & K (and many other law firms) indicate that the proposed definition of disturbed greatly exceeds the legislative intent and statutory scope of the BGEPA. The BRA analysis suggests that the draft Guidelines are not based on sound science, have no flexibility for a fully recovered species, are inconsistent with current bald eagle management being practiced in at least Florida, provide no mechanism for incidental take or conservation measures to benefit bald eagles, and have no grandfathering provisions for existing authorizations granted by the USFWS.

Gopher Tortoise Rule Change (PDF)

On behalf of the Florida Home Builders Association and other regulated industries, I serve on the steering committee of the Gopher Tortoise Stakeholders Group (GTSG), which is meeting monthly to assist the Florida Fish and Wildlife Conservation Commission (FWC) in developing new rules, policies and a statewide management plan for the gopher tortoise (GT). This e-mail is intended to provide BRA staff and concerned clients with an update on GT rule changes in the state of Florida.

Florida DEP Fee Changes (PDF)

ENVIRONMENTAL RESOURCE AND WETLAND RESOURCE PERMIT AND NOTICE FEE CHANGES EFFECTIVE JULY 1, 2008

Legislation recently signed by the Governor (Senate Bill 1294(2008), Chapter 2008-159, Laws of Florida) requires the Department of Environmental Protection to initiate rulemaking to adjust fees related to environmental resource permitting. The legislation also requires the Department to adopt rules for periodically adjusting application fees. It has been determined by DEP that this legislation also applies to the water management districts. The legislation specifically requires DEP to "increase each application fee authorized under Part IV" (of Chapter 373, Florida Statutes) and to "ensure that such fees reflect, at a minimum, any upward adjustment in the Consumer Pride Index compiled by the United States Department of Labor, or similar inflation indicator, since the original fee was established or most recently revised."
